在世贸组织第五次中国贸易政策审议首日会议的发言

尊敬的主席Mariam Md.Salleh大使(女士),
    尊敬的讨论人Joakim Reiter大使,
    各位大使、各位代表:
    很高兴出席世贸组织第五次中国贸易政策审议会议。首先,请允许我对主席女士的致辞和审议讨论人Joakim Reiter大使表示感谢!
    我还要感谢世贸组织秘书处贸易政策审议司的同事们为此次审议会议所做的大量工作,以及他们准备的《秘书处报告》。尽管中国政府对秘书处报告的一些内容持不同看法,但仍然感谢秘书处为此次审议所付出的巨大努力。
    中国政府高度重视这次贸易政策审议会议。过去几个星期,我的团队夜以继日地工作。昨天,我们又收到了3个成员的问题单。共有30个成员向中国提出了将近1600个书面问题。今天,我们尽最大努力,已经完成了26个成员1400多个问题的答复,包括一些在6月17日以后提交的问题。对于剩余的不到200个问题,我们将继续加紧工作,争取会后尽快向大家提交。
    主席女士,改革开放是中国政府的一项基本国策。加入世贸组织以来,中国不断加快改革开放进程,深度融入全球价值链体系,经济社会实现了快速发展。中国新一届领导集体履职后,在十八届三中全会上做出了全面深化改革的重大决定。改革的核心是处理好政府与市场的关系,使市场在资源配置中起决定性作用,更好地发挥政府的作用。目前,各项工作已经全面展开。在中国提交的《政策声明》中,也有详细阐述。在此,我愿就一些重要举措进行介绍。
    ——推进行政审批制度改革。2013年,中国政府共取消和下放416项行政审批事项,修订了《政府核准的投资项目目录》。企业投资《目录》以外的项目,仅需向政府备案,无需报核准机关核准,需报国务院主管部门核准的项目数量减少了60% 。
    ——推进工商登记制度改革。取消公司最低注册资本的限制,将注册资本实缴制改为认缴制。2013年新增私营企业233万家,同比增长30%。
    ——推进财税体制改革。重点推进部分服务业“营改增”试点,逐步扩大试点省份和试点行业。2013年8月,试点推广到全国实行。2014年1月1日起,铁路运输业务和邮政业纳入试点。
    ——推进金融体制改革。中国的利率和汇率市场化改革迈出了新的步伐。中国政府全面放开金融机构贷款利率管制,正式实行贷款基础利率集中报价和发布机制,扩大人民币汇率浮动幅度至2%。
    ——推动中小微企业发展。对部分小微企业减半征收企业所得税,暂免征收增值税和营业税。鼓励民间资本进入法律未明确禁止准入的金融、石油、电力、铁路、电信、资源开发、公用事业、服务业等行业和领域。2013年民间投资增长23%,占全部投资比增至63%。
    ——强化知识产权执法保护。颁布一系列知识产权法律法规,提高侵权赔偿金额,加大对侵权的行政处罚和刑事处罚力度。
    中国政府全面深化改革的一系列举措激发了中国的市场活力,提升了居民消费能力。2013年,中国社会消费品零售总额近24万亿元,最终消费对经济增长的贡献率达到50%。同时,中国政府根据世贸组织倡导的公开、透明和可预见原则,努力营造公平竞争的营商环境。
    主席女士,中国新一届领导集体在致力于全面深化改革的同时,积极主动扩大开放,加快完善开放型经济新体系,采取了一系列措施推进贸易投资自由化和便利化。
    ——简化进口管理程序。取消150多个10位海关编码商品的自动进口许可管理。许可证网上申领工作积极推进。
    ——推动通关便利化。推广海关通关作业无纸化,开展区域通关一体化和“单一窗口”试点。
    ——提高质检等边境程序便利化。从2013年8月15日起,1507个10位海关编码项下的一般工业制成品不再实行出口商品法定检验。
    ——推进跨境人民币结算业务。所有进出口企业均可选择以人民币计价、结算和收付。2013年跨境贸易人民币结算增长57%。截至2013年10月,中国人民银行已与23个国家和地区的中央银行或货币当局签署了货币互换协议,总额度超过2.5万亿元人民币。
    ——继续鼓励外商投资。第三次修订《中西部地区外商投资优势产业目录》,鼓励外商投资中西部地区符合环保要求的劳动密集型产业。此次修订,新增173项。列入《目录》的外商投资项目,可视同鼓励类外商投资项目。
    ——扩大服务业开放。推进金融、教育、文化、医疗服务有序开放。例如,外资可在试点区域设立保理公司,合资证券公司境外股东持股比例可提高到49%。
    ——开展资本项目外汇管理改革。大幅简化直接投资外汇管理,取消外汇账户开立核准等要求。加快QFII额度审批,提高特殊类型QFII机构投资额度上限,扩大RQFII机构和投资范围。
    由于实施上述措施,中国贸易投资保持了持续较快增长。目前,中国已是120多个国家和地区的第一大贸易伙伴。2013年货物贸易进出口近4.2万亿美元,成为世界第一货物贸易大国。其中,进口为1.9万亿美元,同比增长 7.3%,占全球比重升至10.3%,比上年提高0.5个百分点。中国现已成为农产品净进口国。2013年,中国进口粮食1100多万吨。
    2013年,服务贸易进出口达5396亿美元,服务贸易逆差由2012年的897亿美元增加到1185亿美元。中国已是全球第一大服务贸易逆差国。
    中国是全球最具吸引力的投资东道国之一。2013年实际使用外资1100多亿美元,连续21年居发展中国家首位。其中,服务业实际使用外资614多亿美元,同比增长14.51%,首次占比过半。同时,中国对外投资范围扩大,增势强劲。2013年,非金融类直接投资达902亿美元,成为全球对外投资的重要力量之一,也为南南合作做出了重要贡献。
    主席女士,自上次审议以来,中国政府在对外开放方面,还有其他重大举措。例如,2013年9月,中国宣布建立中国(上海)自由贸易试验区,主要试点内容包括加快政府职能转变、扩大投资领域开放、推进贸易便利化、深化金融领域的开放创新、推动政府管理由注重事前审批转为注重事中事后监管等。在推进外商投资管理体制改革方面,探索实施准入前国民待遇加负面清单的外商投资管理模式,为将来推广到全国探索新途径、积累新经验。
此外,中国政府还提出了“丝绸之路经济带”和“海上丝绸之路”重要倡议。
    主席女士,中国是多边贸易体制的积极参与者、坚定支持者和重要贡献者。中国以自己的实际行动坚定不移地支持世贸组织,并积极承担发展中贸易大国应尽的责任。
    ——中国作为APEC成员,支持多边贸易体制。中国今年担任亚太经济合作组织(APEC)东道主,并于5月在青岛举行了APEC贸易部长会议。会议发表了《关于“支持多边贸易体制”的声明》,再次肯定多边贸易体制的价值及其核心和首要地位,呼吁忠实履行“巴厘一揽子”协议,承诺完成《贸易便利化协定》的目标和时间表,敦促世贸组织其他成员为多哈发展议程剩余议题制定明确的工作计划。
    ——中国一直避免采取贸易保护主义,坚持市场开放。中国对各种形式的、削弱贸易和延缓经济复苏的贸易保护主义措施保持警惕。中国坚决反对贸易保护主义,继续致力于最大限度地克制适用可能符合世贸规则但却具有明显保护主义效果的措施。中国按期履行世贸组织金融危机监督机制下的通报义务,支持世贸组织在监督贸易投资壁垒方面开展的工作。
    ——认真参与贸易政策审议。中国政府对世贸组织成员在审议中反馈的建设性意见十分重视。2014年,国务院办公厅下发了《关于进一步加强贸易政策合规工作的通知》(国办发[2014]29号),要求国务院各部门、地方各级人民政府制定有关或影响货物贸易、服务贸易以及与贸易有关的知识产权的规章、规范性文件和其他政策措施时,需就是否符合世贸组织规则和中国加入承诺进一步做好把关工作。
    ——严格执行世贸组织裁决。中国是在执行世贸组织裁决方面做得最好的成员之一。中国尊重专家组和上诉机构的裁决,并保持良好的执行记录。到目前为止,中国在世贸组织被诉案件共19起,其中14起已有裁决。对于被裁决为违反世贸组织规则的措施,中国均在合理执行期结束前取消或进行了修改。
    ——推进实施《贸易便利化协定》。中国根据《巴厘岛部长宣言》所确定的时间表,加快推进《贸易便利化协定》的实施工作。6月30日,中国正式向世贸组织提交了A类措施通报。
    主席女士,中国在坚持发挥多边贸易体制及规则的基础作用的同时,继续推进双边和区域经贸合作。今天,中国与冰岛、中国与瑞士自贸协定生效。
    尽管中国参与了一些双边和区域协定,但中国政府始终认为,以世贸组织为核心的多边贸易体制是推动全球贸易投资自由化与便利化的主渠道,双边和区域协定只是对多边贸易体制的有益补充,而不是替代。
    主席女士,中国自加入以来,积极承担了发展中贸易大国应尽的责任。
    中国关税总水平由15.3%降至9.8%,承诺不使用农产品出口补贴,取消了全部进口配额和特定招标管理,开放了100多个服务部门。中国已连续5年成为最不发达国家的第一大出口市场。自2010年7月1日中国对最不发达国家进口产品实施零关税待遇以来,截至2013年4月,中国从26个受惠国进口商品超过22亿美元,免除关税款 13多亿元人民币。
    中国积极支持世贸组织的促贸援助倡议,从2008年起开始向世贸组织多边框架下的促贸援助基金提供捐款。2011年,中国捐款设立了“中国支持最不发达国家及其加入项目”(“中国项目”)。2012年和2013年,中国又向“中国项目”捐款共80万美元,并在北京举办了“最不发达国家加入世贸组织圆桌会议”。2013年世贸组织第九届部长级会议期间,中国再次向该项目提供40万美元捐款。
    主席女士,当前,中国经济发展形势总体是好的,但也面临不少困难。经济增长存在下行压力,内生动力不足,长期积累的深层次矛盾尚待缓解。
    虽然中国的经济总量已居世界第二,但中国作为一个面临繁重发展任务的发展中国家的基本国情没有改变。目前,中国人均GDP不到7000美元,在全球排名第84位,还有1.28亿人口生活在贫困线以下。中国的城镇化发展还很滞后,还有6至7亿人居住在农村,1亿人在城市的棚户区里生活。中国的工业化任重道远,“中国制造”在全球价值链中总体处于低端位置。中国在继续致力于自身发展的同时,将在国际经贸事务中承担与自身发展水平相称的责任。
    主席女士,未来,中国政府将继续致力于全面深化改革,加快推进行政、财税和金融体制改革,增强各类所有制经济活力。明年,中国政府将把“营改增”试点扩展到电信、金融、建筑、房地产等所有服务业。育幼养老、建筑设计、会计审计、商贸物流、电子商务将逐步放开。
    中国政府将积极推动新一轮对外开放,坚持积极利用外资,推动服务业开放,打造内外资企业一视同仁、公平竞争的营商环境,扩大内陆沿边地区开放,推动出口升级和贸易平衡发展。中国将统一内外资法律法规,完善投资管理体制,进一步加大区域通关改革力度。
    中国将继续支持和维护多边贸易体制,支持多哈回合谈判进程,推动多边贸易体制向更加均衡、普惠、共赢的方向发展。中国希望,处于不同发展水平和阶段的经济体能发扬同舟共济的精神,摒弃零和博弈的做法,携手应对共同挑战,塑造合作共赢的经济全球化新格局。
    主席女士,我的发言到此结束。下面,我愿意倾听讨论引导人和其他成员的评论和问题。谢谢大家。

It gives me great pleasure to attend the fifth WTO Trade Policy Review of China. First of all, I would like to thank you, Madam Chair, for your warm remarks. I would also like to thank His Excellency Discussant Ambassador Joakim Reiter.

My thanks also go to the colleagues in the TPR Division of the WTO Secretariat for their tremendous efforts in preparing this meeting and the Secretariat Report. We wish to thank the Secretariat for the great effort it put in the review, although we hold different views on some of the issues in the Report. 

The Government of China attaches great importance to this review. Over the past weeks my colleagues in dozens of ministries have been working around the clock. We received the last 3 lists of questions just yesterday. Altogether 30 members have submitted to China around 1,600 written questions. By far we have provided answers to more than 1,400 of them from 26 members, including quite a lot of them coming in after the submission deadline of 17 June. For the rest of less than 200 questions, we will continue to work very hard to provide replies as quickly as possible after the review. 

Madam Chair, reform and opening-up has been a basic national policy of China. Since its accession to the WTO, China has expedited its reform and opening-up process. China has integrated deeply into the global value chain, resulting in fairly fast economic and social development. After taking office, the new Chinese leadership has made major decisions to comprehensively deepen the reform at the third Plenary Session of the 18th Central Committee of the Communist Party of China. The core of the reform is to strike a balance between the role of the government and the role of the market, allowing the market to play a decisive role in resources allocation, and bringing the government's role into better play. At present, reform measures are being unfolded across the board, as elaborated in the Government Report submitted by China. I would like to highlight some of them as follows:

With regard to the reform of the administrative examination and approval system, in 2013, the Government of China abolished or delegated 416 items which were previously subject to administrative examination and approval, and revised the Catalogue of Investment Projects Subject to Government Verification. Those investment projects not listed in the Catalogue are only subject to filing procedures instead of verification. As a result, the number of projects subject to examination and approval by competent authorities of the State Council has been reduced by 60%.

As regards the reform of the industrial and commercial registration system, the requirement for minimum registered capital has been removed. The paid-in capital system has been replaced by one of a subscribed capital system. In 2013, 2.33 million private enterprises were established, up by 30% year on year. 

Concerning the reform of the fiscal and taxation system, the pilot program of levying value added tax (VAT) in lieu of business tax in certain service sectors has gained momentum and has expanded to more provinces and sectors. In August 2013, the pilot program was rolled out nationwide. Railway transport and postal services have also been incorporated into this program since 1 January 2014.

In relation to the reform of the financial system, new steps have been taken to marketize interest rates and the RMB exchange rate. The Government of China has further lifted the control on loan interests of financial institutions, adopted the centralized quotation and release mechanism for loan prime rate, and widened the fluctuation band range of the RMB exchange rate to 2%. 

Efforts have also been made to support the growth of medium, small and micro enterprises. Some small and micro enterprises are allowed a 50 % reduction in corporate income tax, and temporary exemption from VAT and business tax. Private capital is encouraged to enter sectors including finance, petroleum, power generation, railway, telecommunications, resources exploitation, public utilities and services. In 2013, private investment climbed by 23%, representing 63% of the total investment in the country.

Law enforcement in IPR protection has been strengthened. A series of laws and regulations concerning IPR have been promulgated. The amount of compensation for IPR infringements has been raised, so have the penalties for infringements, both administrative and criminal.

The measures adopted by the Government of China to comprehensively deepen reform have unleashed domestic market vitality and the spending power of the residents. In 2013, the total retail sales reached RMB 24 trillion yuan, and 50% of GDP growth was accounted for by consumption. In the meantime, the efforts have been made to create a level playing field for businesses based on the principles of openness, transparency, fairness and predictability advocated by the WTO.

Madam Chair, China's new leadership is also committed to pressing ahead proactively with the opening-up drive and accelerating the improvement of a new open economic system. In this context, a series of measures have been adopted for the trade and investment liberalization and facilitation. 

Import administration procedures have been streamlined. Automatic import license administration for over 150 tariff lines at the HS10-digit level has been removed and the online application for license is proceeding smoothly.

New progress has been achieved with customs clearance facilitation. Paperless customs clearance has been promoted. Pilot projects for cross-region customs clearance and "single window" services have been launched. 

The facilitation of border procedures including quality inspection has improved. From 15 August 2013 onward, a total of 1,507 tariff lines at the HS 10-digit level from the list of general manufactured products were no longer required for compulsory export commodity inspection.

The RMB settlement business for cross-border trade has also been advanced. Import and export enterprises may choose RMB for quotation, settlement and payment. RMB cross-border trade settlement in 2013 increased by 57% over the year before. By October 2013, the People's Bank of China had signed currency swap agreements valued at over RMB 2.5 trillion yuan with the central banks or monetary authorities of 23 countries and regions.

Efforts have been made to continue to encourage inward foreign direct investment (FDI). The Catalogue of Priority Industries for Foreign Investment in Central and Western China was updated for the third time, adding 173 new items. It encourages FDI in labor-intensive industries that meet the environmental requirements in central and western China. Foreign investment projects listed in the Catalogue can be deemed as encouraged by the government. 

Openness in the services industry has been expanded. Efforts have been made to promote the orderly opening-up of the financial, education, cultural and medical services sectors. For example, foreign investors are allowed to set up commercial factoring companies in pilot areas, and the foreign equity cap in joint-venture securities firms has been raised to 49%. 

The reform of foreign exchange administration for capital account has been carried out. Foreign exchange administration of direct investment has been considerably streamlined, with elimination of requirements for verification concerning the opening of foreign exchange accounts. Approval for QFII quotas has been expedited. The investment quotas for QFII institutions under special categories have been increased. The scope of RQFII institutions and their investment has been expanded too. 

Thanks to the above-mentioned measures, China has maintained sustained and robust growth in her two-way investment and external trade. China today is the largest trading partner of over 120 countries and regions. With a total import and export value of close to 4.2 trillion US dollars in 2013, China became the world's largest merchandise trader. In breakdown, China's import grew by 7.3% year-on-year to 1.9 trillion US dollars, with its share in the world rising to 10.3%. China is now a net importer of agricultural products. Its grain imports exceeded 11 million tons in 2013.

China's services imports and exports reached 539.6 billion US dollars in 2013. Its trade deficit in services rose from 89.7 billion US dollars in 2012 to 118.5 billion US dollars in 2013. Today, China has the biggest trade deficit in services globally.

China is one of the most attractive FDI destinations in the world. Last year, China received more than 110 billion US dollars of actualized foreign direct investment, and ranked top among developing countries for 21 years in a row. In breakdown, the services industry utilized over 61 billion US dollars, up 14% year on year. This was the first time when the services industry utilized more than half of the FDI inflows into China. In the meantime, China's outbound FDI has been growing steadily and expanding into an increasing number of areas. Last year, China's outbound non-financial direct investment reached 90 billion US dollars. This makes China a major source of outbound FDI, and has contributed significantly to the south-south cooperation.

Madam Chair, since the last review, the Government of China has adopted other key measures in pursuing its opening-up strategy. For example, in September 2013, as you mentioned earlier, China announced to establish the China (Shanghai) Pilot Free Trade Zone. The pilot includes key elements such as accelerating the transformation of government functions, expanding sectors open to foreign investment, advancing trade facilitation, deepening liberalization and innovation in the financial sector, and promoting the shift of government administration from pre-establishment approval to post-establishment supervision. With respect to promoting the reform of the foreign investment regime, efforts have been made to explore a model based on the pre-establishment national treatment and negative list approach. The purpose is to blaze a new trail and accumulate experience for a future rollout across the country.

Furthermore, the Government of China has also put forward the important initiatives of the "Silk Road Economic Belt" and the "21st Century Maritime Silk Road".

Madam Chair, China is an active participant, staunch supporter and important contributor of the multilateral trading system. Through concrete actions, China has unswervingly supported the WTO, and has assumed the due responsibilities of a major developing trading nation. 

As an APEC member economy, China strongly supports the multilateral trading system. As the host to this year's APEC meetings, China already hosted the Minister Responsible for Trade (MRT) Meeting in Qingdao this May. As we all know, a standalone Statement on Supporting the Multilateral Trading System was adopted at the MRT. The statement reaffirmed the value of the multilateral trading system and its central and primary status. The statement also called for faithful implementation of the Bali Package, pledged to fulfill the objectives and timetable of the Trade Facilitation Agreement. The statement also urged WTO members to jointly come up with a clear-cut work plan for the remaining issues of the Doha Development Agenda.

China has been refraining from taking trade protectionist measures, and sticking firmly to opening up its market. China remains vigilant over all forms of trade protectionism that undermines trade and slows down economic recovery. China firmly opposes trade protectionism, and will remain committed to exercising maximum restraint in applying measures that may be considered WTO compatible but still have a significant protectionist effect. China fulfills in a timely manner its notification obligations under the WTO's financial crisis monitoring mechanism, for the purpose of supporting the work of the WTO in monitoring trade and investment measures.

China participates in the WTO trade policy review in an earnest manner. The Government of China takes very seriously the constructive feedbacks from other WTO members in the course of the review. In 2014, the General Office of the State Council of China issued the Circular on Further Enhancing Trade Policy Compliance. The Circular requires the State Council departments, and governments at provincial level to ensure that when the regulations, regulatory documents and other policy measures relative to or with an influence on trade in goods, trade in services, and trade-related intellectual property rights are formulated, they should be consistent with the WTO rules and China's accession commitments.

China strictly implements WTO rulings. China has one of the best track records of implementing WTO rulings. China respects the verdicts made by the panel and the appellate body. Up until now, 19 complaints have been lodged against China under the WTO, and 14 of them have arrived at a final ruling. China cancelled or revised all the measures that had been determined inconsistent with WTO rules within the period of implementation.

China further advances the implementation of the Agreement on Trade Facilitation according to the timetable set up by the Bali Ministerial. China notified Category A commitments under the Agreement to the WTO yesterday.

Madam Chair, while remaining committed to giving full play to the fundamental role of the multilateral trading system and rules, China also continues to press ahead with bilateral and regional trade and economic cooperation. Just today, China's free trade agreements with Iceland and Switzerland are entering into force respectively. 

Although China has participated in some bilateral and regional agreements, the Government of China always believes that the multilateral trading system with the WTO as its core is the main channel for promoting global trade and investment liberalization and facilitation. Bilateral and regional agreements are useful supplement to the multilateral trading system, rather than its replacement.

Madam Chair, since its accession to the WTO, China has actively assumed its due responsibilities as a major developing trading nation.

China has cut its overall tariff level from 15.3% to 9.8%, and pledged not to use agricultural export subsidies. China has also eliminated all import quotas and specific import tendering requirements, and opened up over one hundred services sectors and sub-sectors. China has been the largest export market for the LDCs for five consecutive years. On 1 July 2010, China began to provide duty-free treatment to exports from the LDCs. From then on to April 2013, China imported over 2.2 billion US dollars of goods from 26 beneficiary countries, and offered a tariff exemption of RMB1.34 billion yuan.

China actively supports the Aid for Trade Initiative of the WTO. Since 2008, it has been contributing to the Aid for Trade Fund under the multilateral framework of the WTO. In 2011, China established "China's LDCs and Accessions Program" (the China Program). In 2012 and 2013, China donated 800,000 US dollars in total to the China Program and hosted the Roundtable for the LDCs' WTO Accession in Beijing, China and Luang Prabang of Laos. During the MC9 in 2013, China contributed another 400,000 US dollars to the China Program.

Madam Chair, at present, the overall momentum of the economy in China is good. Nevertheless, difficulties remain. Economic growth faces a downward pressure, and the internal driving force for growth is less than sufficient. The long-standing and deep-rooted problems are still waiting to be addressed. 

Although it is already the second largest economy in the world, China remains a developing economy facing daunting development tasks. At present, with per capita GDP below 7,000 US dollars, China ranks the 84th in the world. Today, some 128 million people in China still live below the poverty line according to UN standards. China's urbanization process still lags behind. Some 600 to 700 million people are living in the rural area, and 100 million people in shanty towns in cities. China also has a long way to go to realize industrialization. Overall, products "Made in China" remains at the lower end of global value chains. As it fulfills its own development tasks, China also stands ready to assume responsibilities in international trade and economic affairs commensurate with its own level of development.

Madam Chair, going forward, China will remain committed to comprehensively deepening reform through accelerating the restructure of administrative, fiscal and financial systems to boost economic vitality across the ownership spectrum. Next year, the Government of China will roll out the pilot program of levying VAT in lieu of business tax to more services sectors such as telecommunications, finance, construction and real estate. China will also gradually lift access restrictions on foreign investment in child and elderly care, architecture design, accounting and auditing, commerce and logistics, and e-commerce.

The Government of China will push forward a new round of opening-up. It will actively utilize foreign investment, further open up the services sector, and create a level playing field for Chinese and foreign businesses to compete on an equal footing. China will also further open up inland and border areas, and promote upgrading of export mix and trade growth in a balanced manner. It will unify laws and regulations for domestic and foreign investors, improve the investment administration regime and further step up the reform on cross-region customs clearance. 

China will continue to champion and safeguard the multilateral trading system, support the Doha Round negotiations, and help steer the multilateral trading system towards greater balance, universal benefit and win for all. The Government of China hopes that economies at different development levels and phases would embrace the spirit of solidarity in times of adversity and discard zero-sum practices. China is ready to work with other WTO members to meet common challenges and shape a new prospect for economic globalization featuring win-win cooperation
