Anti-dumping

Question 1

  As the fifth largest user of Anti-dumping investigations among all members (according to WTO statistics from 1 January 1995 to 30 June 2002), South Africa has launched 27 anti-dumping investigations against products from China since 1990. To date, as many as 15 Chinese products including door lock, garlic and etc are still subject to the anti-dumping duties by the South Africa, which has negatively affected the bilateral trade development between China and South Africa. What measures has South Africa taken to prevent the adverse impact by the adoption of those Anti-dumping actions from hampering the healthy development of bilateral trade? Can South Africa explain what has been done on its part to ensure the consistency of its Anti-dumping measures and practices with the multilateral disciplines and obligations?

  The tariff regime of South Africa is characterized by its complexity. Its membership of a wide range of regional and bilateral trade arrangements has subjected its trade partners to different access conditions to its market. The normal trade has the possibility to be distorted under the regime of such complexity and the uncertainty with regard to the fulfillment of WTO obligations appears more likely. What steps has South Africa taken to prevent these cases from happening?

Foreign Exchange Control

Question 3

  The extent and means of foreign exchange control has major impacts to the environment for investment of SACU. There seems to be a rather high degree of uncertainty related to the current forex regime of SACU which can be illustrated by the experience of some foreign banks in South Africa. When they applied for investing in foreign currency sovereign debts, participating in syndicated loans issued by South African enterprise or the South African Reserve Bank (SARB) abroad, South African competent authorities seemed not to have clear criteria in dealing with these applications.
How does SACU ensure: (1) the transparency of its forex administration in terms of the policy implementation, and (2) explanation has been given to each and every denied application in a timely and appropriate manner?
